HC stays survey of Gyanvapi complex by ASI | India News – Times of India


PRAYAGRAJ: The Allahabad high court on Thursday stayed a Varanasi fast-track court’s April 8 order directing the Archaeological Survey of India to “conduct a comprehensive physical survey” of the Kashi Vishwanath Temple (KVT)-Gyanvapi mosque complex, saying it failed to maintain “judicial courtesy and decorum” in its haste to issue the directive, reports Rajesh Kumar Pandey.
Justice Prakash Padia said the lower court shouldn’t have issued any order in this matter once the high court, which is hearing a batch of cases related to the KVT-Gyanvapi dispute, reserved its judgment on the pending petitions in March.
He granted three weeks’ time to the Centre and the state government to file their replies.
“The judgment was reserved in all pending petitions by this courton March 15. The court below has full knowledge of the fact that the judgment has already been reserved… In view of this, the court below should not have proceeded and decided the application filed by the plaintiffs in the original suit for survey by ASI,” the court said in its 26-page order.
